Terms of Use
AquaVal, a service of Queensland Water Consultancy · Version 1.0, September 2026
These terms apply when you use AquaVal. By entering your details and using the service you accept them. Please read the section on what an AquaVal valuation is, and is not, before you rely on a report.
1. The service
AquaVal produces an indicative valuation of a Queensland water entitlement from recorded market evidence, published government trade and relocation data, and the entitlement details you provide. It is operated by Queensland Water Consultancy.
2. What an AquaVal report is, and is not
- The valuation reflects recorded evidence for comparable entitlements, not an inspection or an assessment of your specific entitlement, its reliability, its conditions or any encumbrance on it.
- Market evidence is limited and, in some water plan areas, thin or absent. Where evidence is thin the report says so, and the figure should be treated with corresponding caution.
- Government data is published periodically and may not reflect the most recent trading.
- The report should not be used as the sole basis for a sale, purchase, loan, security, financial statement, court proceeding or tax position. Where a formal valuation is required, ask us for one.
If you would like a formal valuation or advice on a specific matter, contact us at water@qldwc.com.au or on 0418 840 896.
3. Information you give us
The valuation depends on the details you enter, including the volume, water plan area, sub-area, scheme, priority group and entitlement type. You are responsible for the accuracy of those details. A valuation produced from incorrect details will itself be incorrect. If you notice an error, tell us and we will reissue the report.
4. Fees and payment
The fee for a valuation is shown before you pay and is payable in Australian dollars. Payment is processed by Stripe. Your valuation is produced immediately after payment and remains available in your browser for that session. Because the report is delivered immediately, fees are not refundable once the valuation has been produced, except where the law requires otherwise or where we agree that the report was materially wrong through our error.
5. Where no market evidence exists
Some entitlements have no recorded comparable sales. In that case AquaVal cannot produce a figure and we will tell you so. Queensland Water Consultancy will prepare the valuation by hand and send it to you, at no additional charge.
6. Your use of the report
The report is prepared for you, for your own purposes. You may share it with your advisers, financier, family or a counterparty to a transaction. You may not resell it, republish it, or present it as your own work or as a formal valuation. Copyright in the report, and in AquaVal itself, remains with Queensland Water Consultancy.
7. Availability
We aim to keep AquaVal available at all times, but it depends on government data sources and third-party services and may be unavailable from time to time. We may change or withdraw features.
8. Liability
Nothing in these terms excludes any right or guarantee you have under the Australian Consumer Law. Subject to that, and to the extent permitted by law, Queensland Water Consultancy's liability arising out of or in connection with a valuation is limited, at our option, to resupplying the valuation or refunding the fee you paid for it. We are not liable for indirect or consequential loss, including loss of profit or opportunity, arising from reliance on a report contrary to section 2.
9. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.
10. Governing law
These terms are governed by the law of Queensland, and you and we submit to the courts of that State.
11. Changes
We may update these terms. The version and date appear at the top of this page, and the version you accepted is recorded with your valuation.
